Terms of Service

These Terms govern your use of Ulivo — the family archive and genealogical research service. By creating an account or using the service, you agree to these Terms. Please read them. If you don't agree, please don't use Ulivo.

1. Who Can Use Ulivo

You must be at least 18 years old to use Ulivo. By using the service, you represent that you are 18 or older and have the legal capacity to enter into a binding agreement. Ulivo is not directed at children under 13, and we do not knowingly collect information from them.

2. Your Account

When you create an account, you agree to provide accurate and complete information. You're responsible for maintaining the security of your credentials and for all activity that occurs under your account. If you suspect unauthorized access, notify us immediately at hello@ulivo.family.

3. Subscriptions and Payment

Ulivo offers free and paid subscription tiers. Paid plans are billed on a recurring monthly or annual basis and renew automatically until cancelled. You can cancel at any time from your account settings — cancellation takes effect at the end of your current billing period.

We use Stripe to process payments. We do not store your credit card number. All payments are non-refundable, including for partial billing periods, except where required by law. We reserve the right to change pricing with 30 days' advance notice.

4. Your Content

You own the content you upload to Ulivo — your voice recordings, photos, family stories, and tree data. By uploading content, you grant Ulivo a limited, non-exclusive license to store, process, and use that content solely to provide the service to you. We do not claim ownership of your content.

You represent that:

You have the right to upload any content you add to Ulivo
Your content does not infringe any third party's rights
You have appropriate permission to add information about family members, including living individuals

5. Family Member Data

When you build your family tree, you may add information about other people — living or deceased. You take responsibility for having appropriate permission to do so. We recommend limiting data about living individuals to family members who have consented to being included, and exercising care with sensitive personal details.

Ulivo is designed primarily as a private archive for your own family's use. It is not intended as a tool for researching or documenting individuals without their knowledge.

6. AI Processing and Historical Records

Ulivo uses artificial intelligence — powered by Anthropic's Claude — to search historical records, evaluate candidate matches, and generate narrative summaries. When you initiate a genealogical search, your query (including name, approximate birth year, and country of origin) is sent to Anthropic's API for processing.

Important: AI-generated outputs and historical records are provided for personal, informational purposes only. Ulivo does not warrant the accuracy, completeness, or fitness of any record, match, or narrative. Genealogical data is inherently uncertain — names were misspelled, ages were misreported, and records were lost. Treat all findings as starting points for your own research, not definitive facts.

Historical records are sourced from public archives including FamilySearch, the Ellis Island Foundation, the National Archives, the Library of Congress, and FindAGrave. These records remain in the public domain. Ulivo's AI-generated narratives are provided for your personal, non-commercial use.

7. Prohibited Uses

You agree not to:

Use Ulivo for any commercial purpose without our written permission
Attempt to access another user's account or data
Use the service to harass, stalk, or harm any individual
Upload content that is unlawful, harmful, or infringes on another's rights
Attempt to reverse engineer, scrape, or copy Ulivo's technology or data
Use automated tools to access or query the service without permission
Upload malware, viruses, or any code designed to harm

8. Intellectual Property

Ulivo's name, logo, brand, design, and underlying technology are our property and are protected by applicable intellectual property laws. Nothing in these Terms transfers ownership of Ulivo's IP to you. You may not use Ulivo's brand or design elements without written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. ULIVO DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PARTICULAR RECORD OR AI OUTPUT WILL BE ACCURATE OR COMPLETE. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ULIVO AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL ULIVO'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE FEES YOU PAID TO ULIVO IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) $50 USD. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

11. Indemnification

You agree to defend, indemnify, and hold harmless Ulivo and its owners from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the service, your content, or your violation of these Terms.

12. Dispute Resolution and Arbitration

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.

Any dispute arising out of or relating to these Terms or your use of Ulivo will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, except that either party may seek injunctive relief in court for intellectual property violations.

You and Ulivo each waive the right to a jury trial and the right to participate in a class action lawsuit or class-wide arbitration. You may only bring claims in your individual capacity.

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any arbitration will take place in Miami-Dade County, Florida, or via video conference at your election.

13. Cancellation and What Happens to Your Data

Your family's story stays with you — always. Cancelling a paid subscription does not delete your data.

When you cancel a paid plan, your account downgrades to the free Seedling tier. Your family tree, voice recordings, and photos remain intact and accessible. What changes is access to premium features: new AI-powered record searches, archive access, share card generation, and Family Book creation are paused until you resubscribe.

The Seedling tier preserves up to 10 voice recordings and 500MB of photos. Content above those limits recorded during a paid plan remains viewable but may be flagged for export. You can download a complete export of all your data — tree, recordings, and photos — at any time from your account settings, at no charge.

After 90 days of account inactivity, we may move your media files to archive storage to manage costs. Your data remains intact and is restored on your next login. After 24 months of complete inactivity, we will email you with the option to export before any further changes to your storage.

We may suspend or terminate your account if you violate these Terms or engage in conduct we determine is harmful to the service or other users. In cases of termination for cause, we will provide reasonable notice and an opportunity to export your data where possible.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we'll notify you via email or in-app notice at least 30 days before significant changes take effect. Your continued use of Ulivo after changes become effective constitutes your acceptance of the updated Terms.
